Terms of Service

1. Acceptance of Terms

By accessing or using AmperlyEV ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We may update these terms at any time — continued use after changes constitutes acceptance.

2. Description of Service

AmperlyEV is a web application that provides educational content, an AI-powered assistant, charging station mapping, trip planning, charging cost tracking, battery health monitoring, and community forums for electric vehicle owners and prospective buyers.

3. Accounts

  • You must provide a valid email address to create an account
  • You are responsible for maintaining the security of your account
  • You must be at least 13 years old to use the Service
  • One account per person — do not create multiple accounts
  • We reserve the right to suspend or terminate accounts that violate these terms

4. Subscriptions and Payments

  • AmperlyEV offers a free tier and a paid Pro subscription
  • Pro subscriptions are billed monthly ($5.99/month) or annually ($49/year)
  • Payments are processed securely by Stripe — we never see or store your card details
  • Subscriptions renew automatically unless cancelled before the renewal date
  • You can cancel your subscription at any time through the Manage Subscription page in Settings
  • Cancellation takes effect at the end of the current billing period — no partial refunds
  • We reserve the right to change pricing with 30 days notice to existing subscribers

5. Disclaimers and Limitations

Estimates and Data Accuracy

AmperlyEV provides estimates and informational content only. All data including but not limited to charging costs, trip times, range estimates, battery health assessments, and charging station information are approximate. Actual results vary based on driving conditions, weather, vehicle condition, charger availability, electricity rates, and other factors.

AI Assistant

The AI assistant provides general informational guidance about electric vehicles. It is not a substitute for professional advice. Specifically:

  • AI responses are not financial advice — consult a tax professional for EV tax credits and incentives
  • AI responses are not legal advice
  • AI responses are not safety advice — follow your vehicle manufacturer's guidelines
  • AI responses may contain errors — verify important information independently

Charging Station Data

Charging station information (location, availability, pricing, connector types) is sourced from third-party databases (Open Charge Map, NREL) and may be inaccurate, incomplete, or outdated. Always verify charger availability and pricing before relying on it for trip planning.

Vehicle Data (Smartcar)

Vehicle data obtained through Smartcar is provided as-is from your vehicle's telematics system. We are not responsible for inaccurate readings from your vehicle. Battery health estimates are approximations based on range data, not direct battery diagnostics.

6. Affiliate Disclosure

AmperlyEV may earn commissions from products recommended through the Service, including home EV chargers and accessories. Affiliate relationships do not influence our recommendations — we recommend products based on the user's vehicle, electrical setup, and budget. When a recommendation includes an affiliate link, we disclose this clearly.

7. User-Generated Content

By posting content (questions, answers, comments, station ratings) on AmperlyEV, you:

  • Retain ownership of your content
  • Grant AmperlyEV a non-exclusive, worldwide license to display your content on the platform
  • Agree not to post content that is illegal, hateful, harassing, spam, or misleading
  • Understand that we may remove content that violates these terms without notice
  • Understand that community content is public and visible to all users

8. Prohibited Uses

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to access other users' accounts or data
  • Scrape, crawl, or automatically extract data from the Service
  • Attempt to overwhelm the Service with automated requests
  • Reverse-engineer the Service or its AI systems
  • Impersonate another person or entity
  • Post spam, phishing links, or malware
  • Use the AI assistant for purposes unrelated to electric vehicles

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMPERLYEV AND ITS OWNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

We are not liable for any decisions you make based on information provided by the Service, including the AI assistant, trip planner, cost estimates, or charging station data.

10. Termination

We may suspend or terminate your account at any time for violation of these terms, abuse of the Service, or any other reason at our discretion. You may delete your account at any time through Settings. Upon termination, your right to use the Service ceases immediately.

11. Governing Law

These Terms shall be governed by the laws of the State of Minnesota, United States, without regard to conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of Minnesota.
